1. Acceptance of Terms

By accessing or using AI Avatar Generator ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

These terms apply to all users of the Service, including users who are browsers, customers, merchants, and/or contributors of content.

2. Description of Service

AI Avatar Generator is an AI-powered mobile application and web platform that allows users to generate custom avatar images from text descriptions. The Service operates on a credit-based system where users purchase credits to generate avatars.

• 1 avatar generation requires 500 credits
• Credits are purchased through Google Play (mobile) or Stripe (web)
• Credits do not expire and are non-transferable between accounts

3. Account Registration

To use the Service, you must create an account using Google Sign-In or email/password authentication. You agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized account access
• Be responsible for all activities that occur under your account

4. Credits and Payments

Credits are the in-app currency used to generate avatars. All purchases are final unless otherwise specified in our Refund Policy.

• Web Payments: Processed securely by Stripe. We do not store payment card information.
• Mobile Payments: Processed by Google Play. Subject to Google Play's Terms of Service.
• Credit Balance: Credits are stored in your account and do not expire.
• No Refunds on Used Credits: Credits that have been used to generate avatars cannot be refunded.

5. Acceptable Use Policy

You agree NOT to use the Service to generate content that:

• Depicts real, identifiable persons without their consent
• Is sexually explicit, obscene, or pornographic
• Promotes violence, hatred, or discrimination
• Infringes on third-party intellectual property rights
• Violates any applicable laws or regulations
• Is intended to harass, bully, or harm others

6. Intellectual Property

All avatars generated using our Service are owned by you, the user, subject to the following conditions:

• You retain full ownership of avatars you generate
• You may use generated avatars for personal and commercial purposes
• The underlying AI model and technology remains our property
• We reserve the right to use anonymized generation data to improve our AI models

7. Service Availability

We strive to provide a reliable service but cannot guarantee 100% uptime. We reserve the right to:

• Perform scheduled maintenance with advance notice where possible
• Modify or discontinue features with reasonable notice
• Temporarily suspend service for emergency maintenance

We are not liable for any loss resulting from service interruptions.

8. Limitation of Liability

To the maximum extent permitted by law, AI Avatar Generator shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

Our total liability to you for any claims arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the modified Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.
